1. Acceptance of Terms

By accessing or using Searcia.com ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform. These terms apply to all visitors, users, agencies, and clients who access or use the Platform.

2. Description of Service

Searcia is a marketplace platform that connects businesses ("Clients") with service agencies ("Agencies"). We provide tools for agencies to create profiles, showcase their work, and receive enquiries. We provide tools for clients to discover, evaluate, and contact agencies. Searcia does not participate in any transactions between Clients and Agencies and is not a party to any agreements made between them.

3. User Accounts

To access certain features of the Platform, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate, current, and complete information during registration. You may not use another person's account without permission. You must notify us immediately of any unauthorized use of your account.

4. Agency Listings

Agencies listed on Searcia must provide accurate and truthful information about their services, experience, and credentials. Agencies are prohibited from posting false reviews, manipulating ratings, or misrepresenting their capabilities. Searcia reserves the right to remove any agency listing that violates these terms or our community standards. Agencies are solely responsible for the services they provide to clients.

5. Reviews and Ratings

Reviews on Searcia must be genuine and based on real experiences. You may not post fake reviews, incentivize reviews, or submit reviews for agencies you have not worked with. Searcia reserves the right to remove reviews that violate our review guidelines. Agencies may respond to reviews professionally but may not request removal of legitimate negative reviews.

6. Prohibited Conduct

You agree not to: use the Platform for any unlawful purpose; post false, misleading, or fraudulent content; harass, abuse, or harm other users; attempt to gain unauthorized access to our systems; scrape, crawl, or use automated tools to access the Platform; use the Platform to send spam or unsolicited communications; impersonate any person or entity.

7. Intellectual Property

The Platform and its original content, features, and functionality are owned by Searcia and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of content you submit to the Platform, but grant Searcia a non-exclusive license to use, display, and distribute that content in connection with the Platform.

8. Payment and Subscriptions

Certain features of the Platform require a paid subscription. All fees are stated in USD and are non-refundable except as required by law. Searcia reserves the right to change pricing at any time with 30 days notice to existing subscribers. Subscriptions automatically renew unless cancelled before the renewal date.

9. Limitation of Liability

Searcia is not liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Platform. We are not responsible for the quality, safety, or legality of services offered by agencies listed on our Platform. Our total liability to you for any claim arising from use of the Platform shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

Searcia reserves the right to suspend or terminate your account at any time for violation of these terms. You may close your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately. Provisions of these terms that by their nature should survive termination will survive.

11. Governing Law

These Terms of Service are governed by the laws of Bulgaria, without regard to its conflict of law provisions. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Varna, Bulgaria.

12. Changes to Terms

Searcia reserves the right to modify these terms at any time. We will notify users of significant changes by email or by posting a notice on the Platform. Your continued use of the Platform after changes constitutes acceptance of the new terms.
